These Terms and Conditions (“Terms”) govern all tour packages, holiday arrangements, travel services, bookings, reservations, and allied facilities arranged or facilitated by Mashahur.com (“Company”), and by proceeding with any booking, making any payment, receiving a confirmation voucher, or availing any service, the customer, traveller, or guest (“Guest”) confirms that they have voluntarily read, understood, and agreed to be legally bound by these Terms in accordance with the laws of India.


1. Role of Mashahur.com and Scope of Services

Mashahur.com functions solely as a travel facilitator and intermediary that assists Guests in arranging tours, hotels, flights, transportation, sightseeing, activities, visa assistance, and allied travel services through independent third-party suppliers, and it is expressly clarified and agreed that Mashahur.com does not own, operate, manage, control, or supervise any airline, hotel, transport provider, cruise line, sightseeing operator, or activity provider, and accordingly the performance, quality, safety, and delivery of such services remain the sole responsibility of the respective suppliers, subject always to applicable laws.


2. Quotations, Pricing, and Rate Validity

All quotations issued by Mashahur.com are indicative and prepared based on prevailing tariffs, availability, government taxes, fuel surcharges, supplier conditions, and currency exchange rates applicable at the time of quotation, and such prices are subject to change until full payment is received and booking confirmation is issued, and any variation arising due to changes in airfare, hotel tariffs, transportation costs, government levies, supplier charges, or foreign exchange rate fluctuations before or after confirmation shall be payable by the Guest, provided such possibility has been duly disclosed.


3. Booking Confirmation and Payment Terms

To initiate and secure any booking, the Guest is required to make an advance payment as communicated at the time of quotation, which represents a commitment toward services blocked with third-party suppliers and is therefore generally non-refundable, and the balance amount must be paid in full within the stipulated timeline, failing which Mashahur.com reserves the right, after reasonable notice where practicable, to cancel the booking in accordance with supplier policies and applicable law, without further obligation.


4. Cancellation, Refund, No-Show, and Unused Services

In the event of cancellation by the Guest for any reason, cancellation charges shall apply as per the policies of airlines, hotels, transport providers, or other suppliers and may extend up to one hundred percent of the booking value, and any refund, where applicable, shall be processed only after deduction of supplier penalties, Mashahur.com service charges, and payment gateway or banking fees, and no refund shall ordinarily be available for no-shows, early check-outs, missed sightseeing, unused meals, voluntary tour discontinuation, or partially utilized services, except where expressly required under applicable consumer protection laws.


5. Amendments and Changes

Any request for amendment, including but not limited to changes in travel dates, passenger details, itinerary, hotel category, room type, or services, shall be subject to supplier approval, availability, and re-pricing, and Mashahur.com does not guarantee acceptance of such requests, and any additional cost arising due to amendments shall be payable by the Guest prior to implementation.


6. Passport, Visa, and Immigration Responsibilities

The Guest is solely responsible for ensuring possession of valid passports, visas, permits, health certificates, and other documents required for travel, and while Mashahur.com may assist with visa facilitation where specifically agreed, such assistance is limited to documentation support and does not guarantee approval, and Mashahur.com shall not be responsible for visa rejection, delay, denial of boarding, refusal of entry, deportation, or actions taken by immigration authorities, and all visa-related fees shall remain non-refundable as per applicable policies.


7. Flights, Railways, Cruises, and Common Carriers

Mashahur.com shall not be responsible for delays, cancellations, rescheduling, overbooking, route changes, technical issues, or operational decisions taken by airlines, railways, cruise operators, or transport carriers, and matters relating to baggage, seating, meals, refunds, or compensation shall be governed solely by the policies of the respective carrier, with claims to be addressed directly to such carrier in accordance with law.


8. Hotels and Accommodation

Hotel check-in and check-out timings shall be governed strictly by hotel policy, and early check-in or late check-out shall be subject to availability and chargeable directly by the hotel, and certain hotels may require a refundable security deposit payable directly by the Guest at check-in, which Mashahur.com shall not be liable to collect, hold, or refund, and special requests such as room location, view, floor, or bedding preferences shall be treated as requests only and are not guaranteed.


9. Transfers, Sightseeing, and Activities

Transfers and sightseeing services operate on fixed schedules and Guests are required to adhere strictly to communicated pickup times, failure of which may result in the service being treated as a no-show, and in the case of shared or SIC services, Guests may be required to reach designated pickup points at their own cost, and delays caused due to traffic, weather, road conditions, mechanical issues, or operational constraints shall not ordinarily qualify for refunds or compensation.


10. Health, Medical Fitness, and Adventure Activities

Guests are responsible for assessing their physical and mental fitness for travel and activities and must disclose any pre-existing medical condition, disability, pregnancy, or special requirement prior to booking, and Mashahur.com shall not be liable for illness, injury, accident, or medical emergencies occurring during the tour except to the extent mandated under applicable law, and participation in adventure, water, or high-risk activities shall be at the Guest’s own discretion and risk, subject to operator guidelines and local authority regulations.


11. Child Policy and Extra Beds

Children aged five years and above shall generally be charged as adults unless otherwise specified in writing, and child pricing, extra bed provisions, and mattress or rollaway arrangements are governed by hotel and airline policies and subject to availability.


12. Conduct, Discipline, and Right to Refuse Service

Guests are expected to conduct themselves responsibly and in compliance with local laws, customs, and regulations, and any act of misconduct, intoxication, abuse, unlawful behavior, or actions causing inconvenience, risk, or disruption may result in termination of services, subject to applicable law, without entitlement to refund.


13. Force Majeure

Mashahur.com shall not be liable for loss, delay, modification, or cancellation of services arising from force majeure events including but not limited to natural calamities, pandemics, strikes, political unrest, government actions, or adverse weather conditions, and in such circumstances Mashahur.com shall make reasonable efforts to coordinate alternative arrangements or rescheduling where feasible, subject to supplier policies.


14. Travel Insurance

Travel insurance is not included unless expressly stated in the package, and Guests are strongly advised to obtain comprehensive travel insurance independently to cover medical emergencies, trip interruption, baggage loss, and personal liabilities.


15. Baggage and Personal Belongings

Guests are solely responsible for the safety and security of their baggage, valuables, documents, and personal belongings throughout the journey, and Mashahur.com shall not be liable for loss, theft, or damage except to the extent required under applicable law.


16. Photography, Media, and Promotional Use

Mashahur.com may use photographs, videos, or testimonials captured during tours for promotional and marketing purposes, unless the Guest communicates an objection in writing prior to travel.


17. Data Privacy and Communication Consent

Guest information is collected and processed solely for lawful purposes related to booking, service delivery, statutory compliance, and communication, and by proceeding with the booking the Guest consents to such processing and to receiving communications via phone calls, SMS, WhatsApp, email, or other electronic means, in accordance with applicable Indian data protection laws.


18. Complaints and Grievance Redressal

Any complaint or grievance relating to services must be communicated during the tour or within forty-eight hours of completion to enable timely resolution, without prejudice to the Guest’s rights under the Consumer Protection Act, 2019, and Mashahur.com shall make reasonable efforts to address such complaints in good faith.


19. Payment Mode and Fraud Prevention

Mashahur.com does not accept cash payments, and Guests are advised not to hand over cash to any employee, representative, driver, or guide, and Mashahur.com shall not be responsible for losses arising from non-compliance with this instruction.


20. Limitation of Liability

Notwithstanding anything contained in these Terms, and to the maximum extent permitted under applicable Indian law, the total aggregate liability of Mashahur.com, if any, arising out of or in connection with a booking or service and conclusively established as being directly attributable to Mashahur.com, shall not exceed the total service fees actually received by Mashahur.com for the specific booking in question, and Mashahur.com shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of enjoyment, emotional distress, or loss of opportunity.


21. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, and subject to statutory remedies available to consumers, courts at Ghaziabad, Uttar Pradesh, shall have exclusive jurisdiction.


22. Acceptance and Electronic Binding Effect

Payment of advance, issuance of confirmation voucher, or utilization of any service shall constitute valid acceptance of these Terms, and such acceptance through electronic means shall be legally binding in accordance with the Information Technology Act, 2000 and the Indian Contract Act, 1872.
